Dr. Mark Wilhelm worked several years for an international law firm. In spring 2006, he founded the law firm Wilhelm together with Lars Winkler. In the course of a post-graduate program of studies, he obtained the “Master of Insurance Law – LL.M.” He is a specialist solicitor (Fachanwalt) for insurance law.

Dr. Mark Wilhelm acts as a counselor in the field of negotiation. He gives lectures and seminars on this issue and is author of the book “Verhandeln im Schadenfall” (“Negotiation in the event of loss”).

Policy wordings set the course for future claim settlement

The claim settlement in commercial property insurance is often a complex and sometimes disappointing process for policy holders. Policy holders and insurers often have different interpretations of the insurance cover agreed upon and the respective consequences for the claim settlement.

These different understandings often have their reason in ambiguously formulated policy wordings resp. entirely missing clauses.

Claim settlement: are experts always neutral?

After the occurrence of an insured event – particularly in property insurances or business interruption insurances – discussions often arise regarding the cause and the scope of loss.

In such case, insurers and policy holders often agree to instruct an expert. The proposal to involve an expert is often made by the insurer. Policy holders then expect the expert to examine the facts quickly, efficiently and unbiased – and are often disappointed in the end.

The “should have known” of breaches of duty within the context of retroactive insurance

In its judgement of 5 November 2014, the Federal Court of Justice handed down requirements for the policyholder’s resp. insured person’s knowledge about precontractual breaches of duties which are essential for releasing the insurer from his insurance obligations.

Keeping policy holders in the dark with provisional cover notes

When a policy holder gives notice of a claim, the insurer should – as soon as all relevant information is available - provide or deny cover. Lately, insurers often issue only provisional cover notes.

The provision’s legal consequence is that the insurer might reclaim any payments afterwards e.g. by arguing in retrospect that the loss concerned was not insured.

Thus, provisional cover notes do not definitely clarify whether the insurer will eventually pay or not. Policy holders are left in the dark about their insurance cover.

Knockout argument testing clause

Insurers more and more often refer to an alleged breach of the testing clause to deny coverage under product liability insurance. The clause excludes coverage in case a product was not tested according to acknowledged rules of technology or science. But especially in case of exotic products there are no generally acknowledged rules how to test.

JUVE: Wilhelm on par with major law firms

In its 2013/2014 edition published on 28 October 2013, the JUVE guide to the German legal market “Handbuch Wirtschaftskanzleien” again lists Wilhelm as one of the most renowned law firms for insurance law in Germany.

The editors highlight Wilhelm’s growing international business via its cooperation partners in the US and UK as well as in Continental and Eastern Europe. According to JUVE, Wilhelm has already reached the standard of competing major firms when it comes to highly complex cases, especially with regard to D&O.

According to the German weekly FOCUS, Wilhelm Rechtsanwälte is one of the leading German business law firms for insurance.

The ranking was published on Tuesday, 15 October 2013, in the special issue FOCUS-SPEZIAL “Deutschlands Top-Anwälte”.

The research conducted by Statista for FOCUS was based on recommendations by more than 4,200 specialized lawyers and 1,700 attorneys working in major business law firms in Germany. In addition to the number of recommendations, the research team considered the media coverage on the individual firm to evaluate the firm's reputation.

Smart Holding successfully closes acquisition of Bank Forum with Wilhelm

The takeover of Ukrainian Public Joint Stock Company (PJSC) Bank Forum by the investment group Smart Holding agreed earlier this year was successfully closed on 30th October 2012.

The regulatory authorities approved the transaction. The law firm Wilhelm advised the Kiev-based investor Smart Holding on the purchase of the bank from Commerzbank AG. On 30th July 2012 the parties had agreed on the acquisition of Commerzbank’s stake in PJSC Bank Forum of approximately 96 per cent.

With about 500,000 clients and more than 100 branches, PJSC Bank Forum is one of the largest banks in the Ukraine for private and corporate customers. Commerzbank held the majority stake in the bank since 2008.

Lars Winkler and Dr. Friedrich Isenbart of the Wilhelm practice group Corporate/M&A advised on the drafting and negotiation of the sale and purchase agreement in the Ukraine and Germany in cooperation with the Ukrainian law firm Engarde.

Wilhelm expands D&O practice group with Herdter

Dr. Fabian Herdter (35) joins Wilhelm’s insurance law team from 1st September 2012.

Dr. Herdter previously worked at the Düsseldorf office of Heuking Kühn Lüer Wojtek in the practice group Insurance/Reinsurance, where he advised clients among others on liability insurance and group insurance.

Dr. Herdter strengthens Wilhelm’s focus on directors’ and officers’ liability and insurance. During the last years, the law firm was able to steadily expand the representation and advice of companies and managers in this field. “We are happy that Mr. Herdter supports us on the further development of our practice group especially in the area of D&O with his expertise and experience”, says partner Dr. Mark Wilhelm.

Another focus of Dr. Fabian Herdter’s work is on group insurance. As a research fellow at the Institute for Insurance Law/House of Finance at Goethe-University Frankfurt, he obtained his doctorate on group insurance. At Wilhelm, he will advise companies on the drafting of own group insurance concepts.
