In its judgment of 12 October 2011, the Federal Court of Justice (FCJ) commented on the omission of an adjustment of the General Conditions of Insurance (GCI). If the insurers do not regulate the legal consequences of a breach of an obligation according to the new Insurance Contract Act, the regulation of the obligation is in total ineffective. A breach of the obligation will then have no consequences and the insurer has to pay. 12.10.11 |
