Consequences of breaches against obligations agreed in old contracts become ineffective if the insurer does not adapt the general terms of insurance to the new Insurance Contract Act (VVG).
The Higher Regional Court Cologne now had to decide about the effectiveness of a contract clause which was not adapted to the new VVG. The authors discuss the decision of the Court and point out its practical consequences.
