Leadership clauses in co-insurance and layered coverage

Major risks are covered by several insurers. In industrial insurance the parties mostly agree on coverage by so called open co-insurances, by so called layered coverage, or by a combination of these two coverage forms.

In all these cases, the policy holder preferably deals with only one insurer when it comes to the fulfillment of obligations or claim settlement (including litigation).

This can be reached by agreement on so-called leadership clauses, which should be carefully drafted as the article at hand points out.
