Compliance Systems

For us, compliance means more than a thick manual and self-administration. We support decision-makers in setting up a lean but effective compliance organisation.

How we support you

Even certified compliance systems sometimes fail to prevent employee criminality, agreements violating competition law, discrimination or corruption. This is why we look beyond the legal horizon and develop internal processes in collaboration with renowned compliance experts that take into account not only legal but also organisational and socio-psychological aspects.

Organisational advice:

  • Analysing internal processes and identifying high-risk areas of the company
  • Developing compliance structures tailored to the company's risk situation
  • Advising decision-makers on how to deal with high-risk areas
  • Acting as a contact person for whistleblowers (whistleblower system)
  • Advice on German Supply Chain Act and European CSDDD (e.g. on contractual clauses, internal processes, avoidance of liability risks)

Advice after compliance violations:

  • Clarifying facts (e.g. evaluation of whistleblower information)
  • Advising on white-collar crime law and defence in OWiG proceedings
  • Advising on cooperation with authorities and forensic experts
  • Examining questions of manager liability in connection with organisational duties
  • Enforcing insurance and liability claims
What we achieve for you
  • Streamlining of compliance structures
  • Faster identification of compliance violations and actions in breach of duty
  • Liability avoidance for decision-makers
  • Effective defence of the company against fines
  • Compensation for any financial losses resulting from compliance violations

Compliance audit at a multinational company

The initial situation

A new CEO took over the management of an international plant engineering group. The manager was aware of the personal liability risks for compliance violations – and of the compliance risks in the international plant engineering business.

The mandate

Shortly after taking up his post, the CEO therefore commissioned our law firm to analyse the existing compliance structures. With a small team, we were on site at the company's headquarters over several weeks to identify risk areas, to evaluate existing guidelines as well as processes, and to identify potential for improvement in intensive discussions with those responsible.

The result

At the end of our assessment, the company was able to introduce a number of optimisations in the compliance system that did not result in any additional administrative work, but will help to identify and minimise risks of breaches of duty and violations of the law at an early stage in the future.
