[...] „Eine breite Klagewelle gegen die Versicherungsmakler ist nach derzeitigem Stand nicht zu erwarten“, bestätigt auch Mark Wilhelm, Rechtsanwalt mit Schwerpunkt auf Versicherungsrecht in Düsseldorf. „Die missglückte Gestaltung der Versicherungsbedingungen und die unglückliche Kommunikation rund um die BSV haben die Versicherer zu verantworten, nicht die Makler.“
Der Düsseldorfer Jurist bringt hingegen die Rolle der Versicherungsvertreter ins Spiel: Demnach gebe es Versicherer, die BSV-Verträge mit und ohne Listenklausel über ihre Agenten vertrieben haben. „Hier ist schon zu fragen: Warum hat der eine Kunde eine bessere Police bekommen und der andere eine schlechtere?“, so der Experte.
Auch wenn Vermittler nun nicht unbedingt mit Klagen rechnen müssen, obliege ihnen allerdings mitunter die wenig schmeichelhafte Rolle des Boten, der schlechte Nachrichten überbringen muss: „Die Makler hatten in den vergangenen zwei Jahren die nicht gerade beneidenswerte Aufgabe, jene Scherben zusammenzukehren, die die Versicherer verursacht haben.“ [...]
