“We had to file a complaint with the financial regulator BaFin.”

The German daily Süddeutsche Zeitung reports on the problematic flood damage claims settlement process in the Ahr Valley and quotes Raimund Mallmann regarding a dispute involving our client.

In an article in the Süddeutsche Zeitung, journalist Herbert Fromme describes the dispute between our client—a medium-sized packaging manufacturer from the Ahr Valley—and its own insurers. The insurers had claimed that the client had agreed to a reduction in its insured amount and that there was no negligence on the part of the insurance advisor.

[...] “How Generali can seriously insist on this claim is beyond me,” says attorney Mallmann. The insurer’s behavior, he says, was very strange overall. “We asked the insurer to provide us with the form.” Generali, however, did not respond, even though it is obligated to hand over the document under the Insurance Contract Act. “We had to file a complaint with the financial regulator BaFin, which then took appropriate action.” It was only after the regulator’s intervention that Generali finally handed over the form.
