Major Damages and Business Interruption

With our legal and technical expertise, we provide comprehensive support to companies in the special situation of major losses.

How we support you

Major losses such as fires or flooding of production and storage facilities not only lead to expensive property damage, but often also result in business interruptions that threaten the company's existence. Even in the context of large-scale plant construction or infrastructure projects, claims can quickly lead to delays in startup costing millions.

We provide support with:

  • Clarification of the facts under insurance and liability law (including: which loss items are covered by the insurance cover? Are the insurer's objections justified?)
  • Advice on insurance law obligations resulting from the policies at hand (e.g. loss minimisation, clarification)
  • Communication with the involved insurers
  • Support in expert proceedings
  • Asserting claims under machinery and EAR insurance, construction and project insurance, contents and electronics insurance as well as fire and business interruption insurance – if necessary before courts
  • Assessing liability issues between project participants
What we achieve for you

Our support serves to relieve the burden on the organisation of the affected company, to enable a rapid resumption of operations or projects and to compensate for losses as fully as possible.

Our goals for the client:

  • Realising maximum compensation (property damage and loss of earnings) by insurers and liable parties
  • Avoiding costly breaches of insurance contract obligations
  • Rapid return to normal operations

"Wilhelm’s team specialises in representing insurance holders in major damage claims and is considered 'an absolute leader in this field'."

Case closed:
Explosion at US production facility

The damage

A major hydrogen explosion occurred at the US production site of a German chemical company, destroying large parts of the plant complex. The destruction resulted in several months of business interruption at the site. Property damage and the production interruption amounted to a multimillion Dollar loss.

Problems during claim settlement

The settlement of the claim with the company's fire/BI insurer came to a standstill after some time. In particular, the insurer and the insured chemical company disputed the amount of the loss of earnings. In fact, the calculation of the loss of earnings was complex – partly due to highly volatile market prices for the product produced at the site.

Our solution

In the negotiations with the leading insurer, we advised and supported the client's decision-makers. Our team scrutinised the insurer's objections and supported the policyholder with arguments. In the end, our client was able to reach a very satisfactory out-of-court settlement solution with comprehensive compensation.
