Johannes Laiblin

Johannes Laiblin advises our clients on insurance law and liability law matters.

He specialises in property and technical insurance as well as construction insurance. For example, he advises project companies and general contractors following damage in the context of construction and assembly projects as well as plant operators following damage caused by natural forces to factories and power stations. He regularly represents medium-sized companies against their insurers in the settlement of fire damage and business interruption claims.

Johannes also benefits from his technical understanding in connection with product liability issues. He advises clients from the industrial production sector, for example, on recall obligations, liability towards further processing customers as well as claims under liability and recall cost insurance policies.

Johannes studied law on the combined degree programme ‘Corporate Lawyer LL.B.’ at the University of Mannheim. During his studies, he worked in a major international law firm and was able to gain experience in supporting infrastructure projects (e.g. structuring public-private partnerships) and in the area of compliance (in particular in supporting internal investigations).

During his legal clerkship, Johannes worked as a research assistant in our law firm and assisted in the resolution of insurance contract disputes. In this context, he also published on issues of business closure insurance in the journal VersR.

Property insurance:

• Coverage assessment of storm damage to a gas-fired power plant (UK), out-of-court support for the power plant operator in settling the claim with the insurer
• Advising a civil engineering consortium on liability and insurance law issues following major tunnelling damage in the three-digit million range
• Advising an insurer on recourse issues in the settlement of a major explosion claim in the chemical industry
• Representation of several medium-sized companies (recycling, construction industry, metal processing, furniture distribution and others) in judicial and extrajudicial dispute resolution regarding commercial and private building insurance as well as business interruption insurance

D&O insurance and other liability insurance:

• Reviewing the insurance cover of the supervisory board of an insolvent financial services provider
• Advising an aluminium processing company in a product liability case, in particular examination of liability and insurance law issues; advice on the necessity of a product recall and communication with the liability insurer
• Assessing insurance law issues on behalf of an industrial producer in connection with product complaints under liability insurances

• Examination of insurance cover following property and liability claims
• Coordination of expert proceedings during the claim settlement of major damages (property and business interruption)
• Dispute resolution in coverage disputes with the insurer
• Drafting of insurance terms for business insurances such as EAR, CAR, Fire/BI and product liability insurance
