Das Urteil des Bundesgerichtshofs vom 30. September 2025 (Az. II ZR 154/23) zu den Vergleichen des Volkswagen-Konzerns mit ehemaligen Vorstandsmitgliedern sowie deren Managerhaftpflichtversicherern schlägt in der Fach- und Wirtschaftspresse hohe Wellen: Den Deckungsvergleich mit den Versicherern über rund 270 Mio. Euro erklärte Karlsruhe für nichtig. VW habe die Aktionäre vor deren Zustimmung zu dem Vergleich nicht ausreichend über die Tragweite des Beschlusses informiert. Hinter die Haftungsvergleiche mit Martin Winterkorn und Rupert Stadler stellte das Gericht ein großes Fragezeichen, da die Konzernführung offenbar nicht ausreichend ermittelt hatte, wie viel die ehemaligen Entscheidungsträger tatsächlich zur Schadenkompensation hätten leisten können.
