[...] Das Ergebnis des Verfahrens sei für beide Seiten bindend, sagte Wilhelm. „Das Einschalten eines dritten Sachverständigen außerhalb des vertraglich vorgesehenen Verfahrens und ohne Kenntnis des Versicherungsnehmers ist sehr ungewöhnlich, rechtlich bindend ist ausschließlich das Ergebnis des gemeinsamen Sachverständigenverfahrens.“ Es nicht anzuerkennen entbehre jeder rechtlichen Grundlage.
Kritik kommt von Wilhelm auch an der Tatsache, dass die beiden Versicherer anders regulieren als der führende Versicherer Allianz. Bei Mitversicherungsmodellen einigten sich die Parteien darauf, dass der Versicherungsnehmer nur mit dem führenden Versicherer korrespondieren und verhandeln muss. „Entsprechend sieht der Versicherungsvertrag auch vor, dass eine gerichtliche deckungsrechtliche Auseinandersetzung allein zwischen dem Versicherungsnehmer und dem führenden Versicherer zu führen ist“, so Wilhelm weiter. Aber in diesem Fall könne der Versicherungsnehmer den führenden Versicherer nicht verklagen, weil der voll leistet. „Das Konzept der Mitversicherung wird so unterhöhlt.“
